OCI Card: Overseas Citizenship of India

There was news that the government may allow dual citizenship for citizens. However, the government did not eventually go through with the proposal. If such a proposal would have been passed, this would have meant that a person would have been able to hold a citizenship of India along with the citizenship of another country, which may allow the person to vote in the elections and have passports of both the countries simultaneously. Many of the countries around the world allow dual citizenships with their own restrictions; however India decided not to implement it for some reasons.
Instead of bringing the dual citizenship, India passed the proposal of Overseas citizenship of India or OCI. If you are a frequent traveller to India but have a citizenship in another country, you can consider getting an OCI card because it will save you from a number of problems. Visa is the biggest issue when you are travelling. You will have to go through a number of stages to get a visa, however if you have an Overseas citizenship of India, you will not have to face all those problems. You can only get the benefits of OCI card if your country of citizenship allows dual citizenship in one way or the other. In addition, you must have migrated from India to the country of citizenship and not be its citizen from birth.

Overseas citizenship of India is not like a dual citizenship. Unlike dual citizenship, you will not be allowed to vote in any election in India, which necessarily means that you will not have any voting rights under the constitution of India. You will also not get a separate Indian passport; instead you will have a sticker pasted on the passport issued by the country of your permanent residence for your identification that you have an Overseas citizenship of India. You will also not be able to work in the government of India or become a candidate of Lok Sabha/Rajya Sabha/Legislative assembly/Legislative council. You will also not be able to purchase any plantation or agricultural land in the country; however you will become the owner if you inherit the property.

There are many benefits of OCI card. As mentioned before, you will have a sticker pasted on the passport issued by the country of your citizenship. The 'U' sticker will serve as your identification as an OCI and will allow you lifelong travel to the country without a visa. You can also stay as long as you want to stay in the country and will not need a police registration which generally should be done if your stay is expected to exceed 180 days.

Overseas Citizenship of India: OCI Card Application Forms and Fees

Overseas citizenship of India, also known as OCI is a benefit given to Indians who have migrated to other countries and obtained the citizenship of the respective country. Many countries allow their citizens to have dual citizenship where one person can have the citizenship of the country itself and another country in addition. This gives the person voting rights in both countries, right to obtain property, work for the government and other such things, however countries may have reservations under this scheme which may not allow all benefits as a citizen gets because of being a permanent citizen. Overseas citizenship of India gives a number of benefits to people of Indian origin or PIO who have obtained citizenship of some other country.

An Online OCI form can be obtained on the website of ministry of home affairs. An OCI card application form has two parts. Part A has columns which are supposed to be filled online while Part B of the form is supposed to be filled after printing the copy. The registration can be done either as an individual or as family. However, if you are registering as a family and there are more than two minor children than you will have to registration of the third child and any other subsequent child as an individual. This means if there are more than four members in your family (two minor children and spouses), than you will have to fill more than one online OCI form. Make sure that you sign all required fields in the OCI card application form. In case your children do not have a signature, they can give their thumb impression in blue ink. Do not use black ink in any case.

If you are a US citizen, the fess for OCI card processing is 275$, for citizens of other countries, the fees is 295$ or an equivalent amount in the country’s local currency. In case you have a PIO card, the fees will be reduced to 25$ for adults and 145$ for minors. In case you are filling the OCI card application in India, the fees will INR 14,230 for non-PIO card holders and INR 1,290 for PIO card holders. The amount will be paid as a demand draft issued in favour of ‘Pay and Accounts Officer (Secretariat), Ministry of Home Affairs’. The fee is compulsory for everyone and will not be waived off under any circumstances.

For people applying from other countries, the fees can be paid in form of money orders, postal orders or cashier’s check. Personal checks are not allowed for paying OCI card processing fees. The fees can be paid at the embassy of India or Consulate of India in the country of application. In case you are applying as a family, combine the fees of all family members into one postal order, money order or cahier check.
